DISTRIBUTION You are hereby licensed to make as many copies of this SOFTWARE as you wish and distribute the software in its unmodified form via a website You are specifically prohibited from charging for use of or access to, or requesting donations, or bundling with any other software or hardware the SOFTWARE unless you obtain a custom license agreement from DESKTOP365 LIMITED You are not allowed to distribute the SOFTWARE on CD.

Indemnification BY DOWNLOADING, INSTALLING, USING OR UNINSTALLING THE DESKTOP365 LIMITED PURCHASED WIDGET SERVICES, YOU HEREBY AGREE TO, AT YOUR OWN EXPENSE, INDEMNIFY, DEFEND AND HOLD HARMLESS LICENSOR, ITS PARENTS, SUBSIDIARIES AND AFFILIATES, ITS BUSINESS PARTNERS, AND ITS AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS (THE "INDEMNIFIED PARTIES"), FROM AND AGAINST ANY AND ALL LOSSES, DAMAGES, INJURIES, CAUSES OF ACTION, CLAIMS, DEMANDS AND EXPENSES, INCLUDING LEGAL FEES AND EXPENSES, OF WHATEVER KIND OR NATURE ARISING OUT OF, RELATING TO OR RESULTING FROM ANY CLAIM AGAINST SUCH INDEMNIFIED PARTIES OR ANY ONE OF THEM, ARISING FROM OR RELATING TO (I) ANY BREACH BY YOU OF THIS EULA; OR (II) YOUR DOWNLOAD, INSTALLATION, USE OR UNINSTALLATION OF THE PURCHASED WIDGET OR THE DESKTOP365 PURCHASED WIDGET`S SERVICES, INCLUDING, WITHOUT LIMITATION, ANY CLAIM OF PERSONAL INJURY (INCLUDING DEATH), INJURY TO REPUTATION, VIOLATION OF PRIVACY, OR DAMAGE TO TANGIBLE PROPERTY OR DATA (INCLUDING LOSS OF PROPERTY OR LOSS OF USE OF TANGIBLE PROPERTY OR DATA).

12. Changes to these Terms and Conditions You agree that Desktop365 Limited may change these terms and conditions at any time.

You will be able to check and read the current terms and conditions and if you do not agree with them you may uninstall your purchased widget. You are allowed to cancel your license by uninstalling the purchased widget at any time.

13. Desktop365 Widget Services No Personally Identifiable Information Collected. No personally identifiable information is requested by the purchased widget This means the purchased widget doesn't seek any information related to your name, telephone number, address, or your email address. At this time the purchased widget is intended to be a completely anonymous service.

Information Collection In order to improve the purchased widget, and our other services, we may collect certain information from you via the widget. This information includes information about how you interact with the widget such as your queries and your use of widgets functionality The purchased widget does not collect information regarding your internet activity and computer use, such as the URLs of the websites that you visit. We may collect the normal type of information that is already available to the Web sites you visit, such as your operating system and IP address. None of this data contains personally identifiable information; it merely allows us to improve the purchased widgets Services and any other services to better serve you. 14. Jurisdiction The laws of the United Kingdom govern this agreement, without giving effect to conflict of laws provisions. The courts of the United Kingdom have exclusive jurisdiction over all disputes relating to or arising from the execution or performance of this agreement unless Desktop365 Limited wishes to initiate legal proceedings in your home legal district. In all judicial actions, arbitrations, or disputes resolution methods, the parties waive any punitive damages.
